Mr Flynn was a serving Soldier, a Lance Corporal in the Signal Squadron at the time of the accident on the 1st May 2001. Whilst his permanent base was in Krefeld, Germany, he was at the time of the accident on an Army Course at Blandford Army Camp in Dorset.
Mr Flynn was a rear seat passenger in a car being driven by another Soldier, Mr Matthew Rees, the Second Defendant in these proceedings. As a consequence of an accident and subsequent serious collision with a tree, caused by the First Defendant, Mr Flynn sustained serious injuries.
The Claimant was knocked unconscious as a result of the accident upon impact. He was subsequently taken to the Dorset Hospital and was diagnosed as having sustained a serious fracture to the right femur, significant blow to the head resulting in lacerations to the face and scalp and severe bruising.
Psychiatric symptoms
The Claimant suffered from depression as a consequence of his extremely lengthy period of immobility, pain and inability to work following his accident.
Pre accident the Claimant enjoyed past times including football, running, cricket, rugby league and driving which he cannot now do.
Loss of congenial employment
The Claimant has lost the benefit of congenial employment in the Army as a result of the accident which would have continued on balance for a full service of 22 years. The Claimant claims for loss of congenial employment within his global claim for general damages.
