Compensation for TA Soldier Injured in Military Accident


£10,000 for Serving Lance Corporal injured in military accident

A settlement of £10,000 was agreed with the MoD in this military accident case on behalf of a serving Lance Corporal whom was mistakenly injected with a live Combo Pen while on NBC training exercises in 2004. The Claimant was playing the role of a soldier infected with nerve gas. Medical personnel treating should have used a dummy combo pen but instead a “live” pen was used and as a result of which the Claimant was injected with live constituents. He developed a rapid heart rate and received medical treatment. He then developed epigastric pain, nausea, vomiting and gastric ulcers which continued despite treatment.

Liability was admitted by the MoD for this Military Accident Claimant had to prove that his gastric complaint was directly caused by the combo pen and not the result of some underlying cause.

The Claimant was able to remain in military service despite his injuries.

The settlement reflected the pain and suffering of the Military Claimant and also the risks associated with the difficulties in showing that the illness was the direct result of the combo pen and not for other unconnected reasons.
