A midlands woman has received £13,000.00 in compensation after being injured in an industrial accident.
On the date of the accident, Miss X was taking some bin bags to be emptied into a rubbish bin which was located at the back of her employer’s kitchen. In order to reach the bins, Miss X had to descend a stairwell, which had inadequate lighting. As it was dark, she missed one of the steps and subsequently fell. She sustained a fracture of the left tibia and fibula which required fixation with an intramedullary nail.
Her claim was settled by Keri Bowyer of Irwin Mitchell’s specialist Accident’s at Work Team, based in Birmingham.
She said “Under the Workplace Regulations, employers need to ensure that they have systems in place for inspecting and maintaining the workplace in order to prevent such accidents. Had Miss X employers took note of the previous complaints, the danger presented by the lack of lighting might have been detected and remedied prior to the Claimant’s accident.
"Luckily, Miss X has recovered reasonably well, however this was a distressing experience causing her pain and discomfort for a number of months afterwards, which could have easily been avoided through implementation of a proper maintenance regime".
