Enderby v Frenchay NHS Trust and Secretary of State for Health (ECJ)
Equal pay claim
Acknowledged as the most lengthy and comprehensive equal pay claim ever, this is the ongoing case of the female speech therapists’ multimillion pound claim against the NHS Trusts and Secretary of State for Health for equal pay with Hospital Pharmacists and Clinical Psychologists. To date the case has involved 26 Court appearances (including the European Court of Justice), 2,000 applicants and 16 test cases. Ten of the lead cases have settled for £600,000 and the final administration is taking place to settle the remaining successful claims. The resulting pay out of compensation by the government is estimated to be in the region of £30 million.
The Enderby case has been instrumental in the government instituting a review of pay and grading scales throughout the health service, forcing a reappraisal of the value of the work undertaken by female dominated professions in the health service in the form of the "Agenda for Change". In May 1999, Sara Leslie won the Wainwright Trust Breakthrough Award for significant contribution to equality in the workplace as a result of her conduct in these proceedings.
