A Sheffield man has received £11,000 compensation in a claim against a council.

Mr L was cycling along a street in a Nottinghamshire village in April 2004 when the wheel of his cycle dropped into a pothole in the surface of the road causing his cycle to stop suddenly and he fell onto the road.

Mr L suffered a fractured pelvis which required internal fixation and courses of physiotherapy and hydrotherapy.

The case was settled against the council responsible for maintenance of the road by Louise Morgan of Irwin Mitchell's specialist Public Liability team who deal with all cases involving accidents in public places including; slips, trips and falls, dog bites and claims against the council.

She said, "I am pleased to have achieved this settlement for Mr L. He consulted solicitors for his cycling club prior to contacting us who informed him that they did not believe he would succeed with his claim.

"However highway authorities have a duty to inspect and maintain the roads under their care and if they fail to implement and enforce a reasonable system for doing so, claims for injuries caused by the defects in the highway can succeed."
