Our client (aged in her 80’s at the time of the accident) was a passenger in a car being driven in Portugal with her husband. While travelling back from their home there, the driver lost control of the vehicle which came off the road and turned over. On impact the door of the vehicle opened and our client’s arm was dragged along the road. She sustained a serious injury to her left arm which subsequently had to be amputated. Our client also suffered other injuries including psychological injuries.

As the driver of the vehicle was domiciled in England, the claim could be brought in the jurisdiction of England and Wales. This was significant as we were able to obtain English levels of damages for our client and these were significantly higher than would have been awarded by the Portuguese courts.

It was concluded that the driver negligently lost control of his vehicle and a compensation claim was proceeded against the insurers of the driver who settled out of court.

£140,000 in compensation was recovered for injury and consequent financial loss and expense.
