Asbestos disease compensation for mesothelioma
The family of a former carpenter and joiner, Mr X, have received compensation from Salopian Building Company after he developed an asbestos related disease. Mr X was diagnosed with the asbestos related disease mesothelioma in April 2006. Tragically, Mr X passed away in November 2006 but his family have now received a compensation payment from his former employers.
Mr X worked as a carpenter and joiner and subsequently as a foreman for Salopian Building Company, exclusively at the ordinance depot at the Ministry of Defence site in Donnington.
Mr X recalled being exposed to asbestos during his employment when undertaking repair work at the site. He had to remove old asbestos roof sheets and dispose of them. He also had to fit new asbestos sheets to replace them. He used an electric saw to cut the sheets to size and also used to drill holes into them before fitting them into the roofs. Mr X was also required to remove and replace old asbestos guttering with new asbestos guttering. He worked for Salopian Building Company between 1964 and 1972 before becoming a foreman with them. Even after he became a foreman he recalled being exposed to asbestos on a periodical basis when supervising and assisting the workers using asbestos on the site.
Mr X was also exposed to asbestos in 1982 after the fire at the Ministry of Defence’s site. He worked in the camp shortly after the fire which had caused asbestos dust to be spread all through the camp and the local area.
As a result of his exposure to asbestos, Mr X went on to develop mesothelioma from which he tragically passed away. Salopian Building Company subsequently admitted negligently exposing him to asbestos but only after Court proceedings had been issued. The Insurers for the company have now agreed to pay Mr X’s family in excess of £130,000 in settlement of his claim.
Iain Shoolbred, Solicitor of Irwin Mitchell’s specialist asbestos related disease team, who handled Mr X’s claim said "I am very pleased to have been able to resolve the claim successfully for Mr X’s family. The claim was robustly fought by the Defendant but the family greatly appreciated the admission provided by the company that they had negligently exposed him to asbestos during his work".
