Successful Claim against British Rail for Mesothelioma


£200,000 Mesothelioma compensation case

Mr S was diagnosed with mesothelioma in September 2007, aged 61. As soon as he began to undergo investigations he feared the worst having seen and heard about many work colleagues who had developed asbestos related diseases. Mr S worked at the British Rail Doncaster Plant Works for most of his working life between 1961 and 1997.

He was employed as an indentured apprentice coach painter, and later qualified as a coach painter.  He was based in the carriage works at the Doncaster Plant Works.  The paint shop where Mr S was based was next to the carriage fitting department where a form of sprayed asbestos lagging insulation was applied to the steel framework of the railway coaches. Mr S remembered the lads at the Plant Works saying that they had made asbestos snowballs from the sprayed lagging insulation debris which was lying around.  Mr S was therefore regularly exposed to asbestos dust during the 1960s and 1970s when working at the BR Plant Works.

The British Railways Board (Residuary) Company Limited were notified of Mr S’s claim.  They dealt with the claim sympathetically and speedily. A settlement was reached less than 6 months after Mr S contacted us in the gross sum of £203,474, without the need for Court proceedings.
