Bereavement Award Following Daughter’s Death in Road Traffic Accident


A mother has received the maximum bereavement allowance of £10,000 after her daughter was killed in a road traffic accident.

Ms X’s daughter was tragically killed in a car accident that happened whilst she was in the care of the local authority. She was a passenger in a car that veered off the road and collided with a tree. The car burst into flames on impact killing her daughter and her carer, who was driving, outright.

On later inspection, it was found that the vehicle had had defective tyres and, though this could not necessarily be considered to have caused the accident, Irwin Mitchell were able to seek damages against the carer’s employers who owned the vehicle.

Ms X’s claim was settled by Claire Newstead of Irwin Mitchell’s specialist Road Traffic Accident Team.
