Comment Issued On Behalf Of The Smith Family Following Inquest Hearing Into The Death Of Edward Smith:

Road Safety

13/08/2008

Speaking on behalf of the Smith family, solicitor, Tessa Herman, from the Birmingham office of law firm, Irwin Mitchell, said:

"The A43 is a notoriously dangerous stretch of road which has claimed many lives with speed being a significant factor. Mr Smith was attempting to cross the southbound carriageway when he was hit by a car being driven by Mr Keirl.

"We have always maintained that speed was the main contributing factor in this collision and we are pleased that the findings of the police have substantiated this by concluding that, as he approached the scene, Mr Keirl was travelling at a speed well in excess of the 70 mph restriction.

"We will now be considering all the available evidence from today's inquest before advising Mr Smith's family on their next course of action."

Mr Smith is survived by his wife and two children, aged 17 and 11 years.
