Employers must ensure that workers are taught how to do their job properly and safely to avoid accidents or injury. This is a wide ranging duty and covers systems and methods of work, use of machinery and other work equipment, and use of personal protective equipment for example;

Employers are not automatically entitled to rely upon training and experience from previous jobs and must make a proper assessment of a worker’s abilities and knowledge for themselves. They must also ensure that training is regularly refreshed and any new matters (e.g. new work equipment or systems of work) are covered in training. Employers also have a greater duty to look out for more vulnerable, younger, pregnant or temporary workers.

Case studies: poor training in the workplace

The claimant was employed by the defendant as a general handyman. Part of his job was to move clear debris which included empty pallets. He was injured when, after stopping a pump truck that he was using with the back of his legs, his boot got caught and he fell forward injuring his shoulder. He was able to claim for lack of training in use of the truck or manual handling in his time with the defendant. The case settled out of court with the claimant receiving a £5000 settlement.

Compensation for injury caused by inproper machine training

A summer worker sustained crush injuries to two fingers whilst working as a machine operator. The inexperienced worker received improper training with regard to operation of the machine he was using at the time of his injury and crushed two fingers under a press. There was a partial amputation of the tip of one finger and crush injury to the other although it wasn't thought likely to affect the worker's future career. The Claimant obtained an out-of-Court settlement of £11,000.
