About birth injury claims

Not all children who are injured at birth are eligible for compensation - it needs to be shown that injury was avoidable and that the standard of care received was not reasonable. We investigate all kinds of injuries caused both to the mother and to the child during birth. The following are just a few examples:

Child: Cerebral palsy, Erb’s palsy, wrongful birth (a disability which should have picked up before birth), developmental delay, scarring to face/neck

Mother: perineal tear, anal sphincter damage, retained products of conception, sepsis, nerve damage

We also investigate still birth cases or where the child died during or shortly after birth.

If you want to investigate a compensation claim for a child with an injury such as cerebral palsy, it is very likely that that child will be eligible in his/her own right to have that work funded by a Legal Aid Certificate from the Legal Services Commission. Whilst there is a three year time limitation period for claims for adults, that three year period begins at the age of 18, so birth injuries claims must be made before a claimant reaches the age of 21.
