Holiday Illness - Illness Abroad Compensation Claims

Claim compensation for holiday illness / illness abroad

Holidays should be fun and stress-free experiences, but this is not always the case. Unfortunately, some people are unlucky enough to contract illness during their holiday. Not only does this ruin their time away, in some cases it can lead to ongoing health problems long after the holiday is over.

If you have contracted an illness abroad, for example while on holiday or while working abroad, then you may be able to claim compensation for both your illness and, if appropriate, the fact that your time away was ruined.

We have extensive experience in acting for clients who have suffered illness abroad including most, if not all, of the major illness outbreaks abroad in recent years. Our past successes have included a record-breaking group action involving over 1,800 holidaymakers who stayed at a hotel in Majorca in 2003.

Getting the best illness abroad compensation

The amount of compensation awarded in illness abroad claims will depend on the individual circumstances of each case, including the extent of your illness and any financial losses your have sustained.

Levels of compensation can vary from a few hundred pounds to thousands of pounds. Even modest problems occurring on holiday may attract awards of damages in excess of 150% of the cost of the holiday.

Compensation for illness is claimed in addition to compensation for a ruined holiday:

1. General damages - damages awarded to compensate you for the pain and suffering your endured as a result of an illness. This award also reflects any restrictions in your general lifestyle, such as being unable to take part in a hobby or enjoy family life. The amount of damages depends on the duration and severity of the illness, the effect it has on your day to day life, and the risk of any long-term complications.

2. Financial losses - damages to compensate you for past and future losses suffered as a result of your illness, which may include loss of earnings, travel and medical expenses and care.

A typical award for short-term illness would be between £1,500 and £5,000. Where the problems are more serious, awards significantly in excess of this have been recovered.

We set out below some examples from group action claims which illustrate the level of offers put forward by the tour operator originally and the increased settlement figures which individual clients each received after they instructed the ITLG:

Client Duration of client's illness Initial offer by tour operator Settlement achieved by Irwin Mitchell
A No illness No offer £1,524
B 2 weeks £300 £2,845
C 2 months £787.45 £4,112
D 12 months £561 £4,792
E 2 years £1,250 £5,341
F Permanent - moderate No offer £11,450
G Permanent - moderate No offer £17,000
H Permanent - severe No offer £40,000
I Permanent - severe No offer £200,000

Obviously, we cannot guarantee the amount of any compensation you may recover. This will depend on a number of factors including the severity and duration of any illnes symptoms. Awards can be more or less than those referred to above, with compensation being as high as £200,000 for one ITLG client who contracted illness overseas.
