Without a Will
It is a common misconception that in the event of your death, everything will pass automatically to your spouse. In reality, this will only happen if you have no other close living relatives. Similarly, if you do not make a Will, complicated legal disputes can arise over the question of who gets what.
Making a Will is the only way to ensure that you decide how your property and possessions are distributed after your death. This process is complicated further if you have assets in more than one country or you are living abroad.
Living outside England & Wales
We offer a specialised service to obtain a Grant of Probate in England and Wales for the deaths of those who have been living overseas. The need for this service arises when a person with an investment or property in England or Wales dies whilst living abroad. In order to deal with this asset a Grant of Representation is required from the Court.
Usually a probate document will have been obtained to deal with assets held in the country where the deceased is living, but that will not be acceptable for assets held in the UK. Depending on the country in which the individual resides at the time they die, it may be possible to 're-seal' a foreign probate document, so that it will be valid in the UK. Alternatively, it may be necessary to obtain a UK Grant of Representation.
We can deal with either the re-sealing or the application for the grant and can also deal with collecting or transferring the assets held within the UK on behalf of the overseas executors.
