Financial Services Authority Investigations

Financial Services Authority Investigations

FSA investigations legal advice

The Financial Services Authority (FSA) is responsible for regulating financial services in the United Kingdom. The FSA is the single statutory regulator responsible for the authorisation and supervision of deposit taking, insurance and investment business, mortgage lending and advice and general insurance advice. Whilst they exist as much for the protection of responsibly run businesses, they also have the power to investigate and punish potential breaches of the financial services regime.

Our experience in FSA investigations

We advise individuals and company employees in relation to investigations or misconduct proceedings brought by the FSA Enforcement Division for alleged breaches of the FSA's principles, standards, rules and regulations. The team has also advised extensively in relation to criminal and regulatory investigations, from relatively small investigations into market abuse and insider dealing against chairmen and directors of PLCs and breaches of the Money Laundering Regulations, to the most substantial investigation ever conducted by the FSA, the investigation into the Split Capital market. Some of our team have worked on secondment within the FSA Enforcement Division so we have the advantage of understanding the FSA investigation process from both sides.

We can help individuals and employees who approach us in whether in a preventative move or after the event, to understand the implications of an FSA investigation and employee related matters regarding approved person status, so they avoid any inadvertent rule breaches or to defend or mitigate the position. We deal with FSA investigations covering issues such as:

  • Market abuse
  • Insider dealing
  • Misleading statements
  • The financial promotions regime
  • The FSA's Principles for Businesses
  • Fit and Proper Test for Approved Persons
  • FSA Handbook Standards and Rules
  • The FSA's powers of investigation
  • Money laundering
  • Mis-selling

We can advise pre-investigation, during an investigation whether civil, criminal or regulatory / disciplinary, involving the Regulatory Decisions Committee (RDC), Financial Services and Markets Tribunal (FSMT) or the civil or criminal courts.

We regularly work closely our employment team if employment related issues arise as a result of an FSA investigation or an internal employee disciplinary or misconduct matter.
