Professional negligence claims

Professional negligence solicitors

When we enlist the help of professionals, we are right to expect a certain standard of service, especially where the professional is entrusted to deal with a specialist matter which as clients, we often have to accept their word about. Where professional negligence causes financial loss, we can help you take action.

Our expertise in professional negligence claims

We act for a wide variety of clients on all kinds of professional negligence claims arising from the carrying out of legal work to the provision of investment advice. As leaders in our field, the broad range and high quality of our work is reflected in the fact that we are involved at any given time in approximately 350 cases, from substantial group actions or large commercial claims, to routine claims arising from things like the sale and purchase of property.

About professional negligence claims

When you embark on a professional negligence case, it is because you have been let down by a professional service, so it pays to work with a team that won’t leave you further disillusioned. Professional negligence is a specialist area of the law, and we are experts in it, currently acting in cases worth in excess of £10m. When we take on a case, we have a wealth of knowledge and experience to draw on from across the team and beyond. We are well versed in all types of case, with an unrivalled expertise.

Professional negligence advice

If you seek our help it is because you have been let down by a company or individual who has sold you a professional service, and you have been unable to resolve the matter between yourselves. We can often take on the negotiations at that stage, seeking to obtain financial compensation for you.

At present, the claims we are most commonly asked to take on are:

  • Claims arising from the conduct of solicitors or barristers in failed litigation – these may be failed personal injury claims or failed commercial litigation, and ironically many mishandled professional negligence claims!
  • Misselling of financial products such as pensions, share portfolios, endowments and with profits policies.
  • Claims against architects, often jointly with builders.
  • Claims against surveyors for failing to properly value or identify defects with property being purchased.
  • Negligent tax advice, in particular inheritance tax planning.

In all cases, we explore non-litigious courses of action first in an attempt to resolve the claim out of court. However, where matters do escalate we are equally able to deliver focused support, practical guidance and effective representation, drawing on the whole firm’s knowledge and resources for the best results.

Professional negligence time limitations

As with most compensation claims procedures, time limitations apply. As soon as you are aware that a professional has been negligent or consider that you have suffered financial loss by their actions, you should seek our help. To delay means risking the legal validity of your case entirely. It may also prevent us from effectively taking steps to limit your loss.

Equally though, the professional in question must also work under time limits. When we have gathered your evidence and formulated a case, we issue a Letter of Claim to pass on to their insurers. They then have three months from the date of receipt to provide a detailed response.

Funding your professional negligence case

The dispute resolution team is committed to providing you with the latest funding options and we are able to offer a variety of arrangements including public funding, conditional fees and after the event insurance arrangements. We will discuss your specific options early on and will do everything we can to assist you in choosing the right route for you.
