Partner at Irwin Mitchell

Yogi was admitted as a solicitor in 1998 and joined IM in 2000 after dealing with a broad range of judicial review work in London. He has extensive experience in conducting successful judicial review cases in relation to a wide range of public functions: Social Services, Healthcare, Housing, Education, Immigration, Criminal Justice and Prison Law. Yogi is nationally recognised as a leading practitioner in Public law and Human Rights law. Yogi was made a Partner at IM in 1997.

He specialises in the healthcare and community care fields. Yogi has negotiated settlements of care packages and obtained interim High Court injunctive orders in judicial review proceedings. He has advised on fair access to care services, eligibility criteria and charging policies. He has acted in proceedings involving a number of local authorities and healthcare trusts in England & Wales, most notably in the high profile Herceptin litigation in 2006 (Rogers v Swindon PCT). Yogi has acted in a number of challenges brought against a NHS PCT’s decision of refusal to fund life saving treatment.

In the last few years, Yogi has become heavily involved in adult welfare proceedings brought by local authorities, mainly acting for the Official Solicitor in declaratory High Court or Court of Protection proceedings, or guardianship proceedings, in the county court, involving individuals who may lack capacity to manage their affairs and decide on welfare, residence, contact and healthcare matters themselves. Yogi has chaired negotiation meetings in this area.

Yogi advises on disability and elderly client issues. He has advised and represented individual clients, care homes, charities and other institutions on matters involving the Disability Discrimination Act 1995, Mental Capacity Act 2005 and Mental Health Act 2007.

With the implementation of the Mental Capacity Act, Yogi has been involved in training events both internally and externally.

Yogi has also provided business immigration advice to individuals and institutions.

Recently, he was recognised for his legal aid work last night as he was named Social and Welfare Lawyer of the Year.
