MS Aurora's grand voyage cancellation

On 20 January 2005, P&O cancelled their world cruise on the Aurora due to technical problems.

P&O have offered passengers a refund of their fare plus a 25% cruise credit on another cruise holiday booked with P&O before the end of January 2007 in line with their terms and conditions.

We are advising passengers on the level of this offer and are offering a free initial consultation to anyone wishing to take advice on the level of this offer. A number of passengers have already registered their interest with us in joining a group action and we are currently in the process of assessing the group's potential.

Our initial view is that, whilst on the face of it, P&O Cruises' offer of a full refund of the fare paid plus a 25% cruise credit on another cruise holiday booked with P&O Cruises before the end of January 2007, may be attractive to some passengers, other passengers may have special circumstances that may justify a higher level of compensation. The amount of compensation each passenger can expect to receive may vary depending on the level of disappointment suffered by each passenger. Passengers who were celebrating a special event such as an important wedding anniversary or birthday may well be entitled to a significantly higher sum.

Should we receive sufficient interest we propose obtaining advice from a barrister as to the merits and value of the claims and as to the suitability of the claims being pursued as a group action. We shall, in due course, be writing to those passengers who have registered their details with us regarding this in more detail. We will also be writing to those passengers who have registered their details with us in due course in relation to the funding of their claims. It may be that we will be able to act on a "no win no fee" basis. In the meantime we have assured those passengers who have registered their details with us that they have no liability for our fees.

In accordance with P&O's standard terms and conditions passengers who wish to bring a claim are required to write to P&O setting out their complaint within 28 days after returning from the cruise and we are advising passengers who are considering bringing a claim to write to P&O accordingly if they have not already done so.

We are also advising passengers who are considering bringing a claim against P&O not to cash any cheque or accept any offer they may receive from P&O without first taking legal advice.
