Katrina Elsey of our Public Liability team helped a client to claim compensation after they were injured in a pub accident.

Our client was sitting on a stool in a pub and tried to move the stool forward. The top surface of the stool was loose and as she sat down again she trapped her right index finger between the top of the stool and the remainder of it.

There was no bleeding from the finger but it was painful and our client went to A&E. An x-ray was taken which revealed a fracture in her finger. Our client received physiotherapy and had difficulty cooking, opening bottles, doing her hair and make-up.

Liability was admitted and an out of court settlement of £6,500 was agreed.

Katrina Elsey commented on the case: “It is important that establishments ensure that any furniture is assembled correctly and is of satisfactory quality. In this instance the stool was defective and placed near the bar where the pub should have known that customers would sit upon it. The accident could easily have been prevented by removing the stool and / or repairing it prior to the client’s accident.”
