An out of court settlement of £85,000 was awarded to a Territorial Army soldier whom was injured off duty whilst cycling home from his civilian employment.

The Claimant was injured when a car pulled across his path. The claimant was unable to avoid a head on collision with the vehicle and impacted with the front grille of the car head on.

The Claimant was treated for serious injuries to his face, namely multiple facial fractures, fractures to his nose, and significant dental injuries.  The claimant required a trachaeostomy upon arrival at hospital to assist his breathing.  He underwent a number of operations to his facial fractures and dental injuries.  The Claimant would require dental implants but this could not be undertaken at the time of settlement as the claimant required further treatment to re grow the bone in his jaw to hold the implants. The claimant was left with obvious facial disfigurement and scarring.

The driver of the vehicle was uninsured and therefore the claim was submitted to the Motor Insurers Bureau whom compensated the claimant.

The claimant was able to carry on with his civilian employment following a period of initial sick leave.   He was keen to return to his military duties in the TA and did so.

The settlement awarded to the claimant represented damages for the pain and suffering for the injuries and the effect of the facial disfigurement. It also incorporated an amount for the cost of private dental treatment by way of implant surgery and ongoing costs for the remainder of the claimant’s life.
