Cathryn Selby was instructed on behalf of a company in a claim against their insurance broker.

The company’s insurance broker added an unconnected co-insured to an insurance policy with the result that a misrepresentation by the co-insured meant that the policy was avoided ab initio by the insurer. This left the company without insurance cover for a period of time and retrospective cover was not available.

Cathryn successfully pursued a substantial commercial settlement on behalf of the company. She recovered losses representing the loss of insurance for the period of time that the company was without insurance, the costs of increased premiums for replacement insurance and losses reflecting business interruption that occurred as a result of being without insurance for a period of time. She also recovered the company’s legal costs in pursuing this settlement.
