Irwin Mitchell's occupier’s liability team have successfully recovered compensation for a man injured when he was struck by a piece of falling equipment in a Virgin Active gym.
Our client was attending the gym when the bolts securing a machine being used by another gym member came loose. As a result, the machine toppled over and struck our client, causing him to sustain injury.
The man suffered soft tissue injuries to his right shoulder, back and right leg. As a result, he suffered pain for a significant amount of time and required assistance with activities of daily living for several weeks. He was off work for three months and has subsequently been diagnosed with a psychological disorder arising from the accident, for which he is receiving therapy.

An adequate inspection should have been carried out to ensure that all equipment was in working order and to remedy any potential hazards in good time.
