Cathryn Selby recently represented a successful machine tooling company in their claim against a national property developer. The developer’s excavations for new student accommodation on land adjacent to our client’s factory caused significant subsidence and cracks to appear in their factory. This resulted in the HSE placing a Prohibition Notice on the site.

Cathryn’s client was forced to find alternative premises and was unable to trade for a number of months causing significant financial losses. Although insured, not all of the losses suffered by our client were covered by their insurance therefore they were forced to pursue the developer for their uninsured losses.  

Cathryn helped her client negotiate and secure a favourable settlement in excess of £425,000. Importantly, costly and lengthy court proceedings were avoided and the settlement money helped the client invest in new machinery whilst allowing the client to focus on its business rather than on protracted legal proceedings.
