A 22 year old man who tripped on an exposed cable whilst walking along a footpath in Nottingham has won a claim against Virgin Media.

The man tripped on the remnants of cable that was protruding out of the footpath he was on and consequently fell onto his left side. Medical evidence confirmed that the Claimant sustained injury to his lower back and abrasions to the left elbow and left knee.  A prognosis for a recovery period of 9 months was given.

Initially a claim was made against Nottinghamshire County Council in 2010. The Council stated that the cable was  NTL apparatus, which has since been taken over by Virgin Media.  A claim was therefore intimated to Virgin Media in January 2011. NTL/Virgin never made a formal admission of liability but following the disclosure of the medical evidence; damages were settled in the sum of £2,000.00 for the client. The client also received payment of the legal costs.
