An out of Court settlement has been reached on behalf of our client who sustained serious injuries when he was run over by a van on a road close to his home in Warwickshire.
Our client was only 6 years old at the time of the accident and had been waiting for his school bus. For reasons that were not known he ran into the road and was struck by a passing van.
Stephen Nye, Partner in our Birmingham office handled the case and commented, " This was a very difficult case to run as there was a lack of independent witness evidence and it seemed to be the case that my client ran out into the road giving the van driver little chance to avoid the impact. However, detailed investigations and the use of expert reconstruction evidence enabled us to present a persuasive case on behalf of our client.
Shortly before the trial a six-figure settlement was agreed between the parties and subsequently approved by the Court. This money will be managed by the Court of Protection and will provide some financial security for my client in his adult years. he will unfortunately have long term problems because of his injuries. This case illustrates the need for the fullest of enquiries, which can result in positive outcomes for those with serious injuries".
