In August 2002, our client had left a club in the early hours and was sat in his car.

Police arrived and accused him of drink driving and proceeded to obtain a specimen of breath. Our client was allegedly threatened with arrest - a scuffle ensued which resulted in our client being struck with batons and sprayed with CS gas.

Other police officers were called and whilst waiting for a police van, it is alleged that our client was kicked repeatedly on the floor whilst handcuffed.

Our client suffered serious injuries, including a broken leg.

He was acquitted of all charges laid against him.

A claim for damages against the police was made for false imprisonment, assault and malicious prosecution. Evidence was obtained from two independent witnesses.

The claim was eventually settled out of court for a substantial five figure sum plus payment of legal costs.
