A £1 million out of Court settlement has been secured by Irwin Mitchell on behalf of a former army sergeant who suffered a severe brain injury following an accident in Afghanistan involving a Chinook helicopter.

Our client was medically discharged from the army as a result of his injuries and his employment prospects for the future have been severely affected due to ongoing disabilities.

Andrew Buckham from Irwin Mitchell’s specialist Armed Forces Team, was instructed to represent the client in a personal injury claim against the Ministry of Defence (MoD). The MoD admitted liability in this case but due to the nature of the injuries to our client, the team spent time gathering expert medical and care evidence to ensure that our client received the maximum amount of compensation available.

The award of compensation was fully justified and also takes into account an amount to compensate him for his injuries, past and ongoing loss of earnings, care, military benefits and pension and terminal grant which he would have been entitled to receive at the end of his military career as there was evidence to support that our client would have continued in the army to complete 24 years. 

The claim was eventually settled by way of a Joint Settlement meeting, and as a result of our clients injuries, a specialist brain injury case manager was retained along with a support worker to ensure that his future care was suitable. The compensation also enabled the client to purchase a bungalow as his current accommodation was deemed unsuitable.
