Irwin Mitchell has assisted a man to obtain compensation after he was injured because a hospital fitted him with an orthosis which was not of satisfactory quality.

Our client had worn an orthosis and a special boot on his left leg throughout his life.

In September 2009 he was in his garden wearing the orthosis. Suddenly and without warning one of the components of the orthosis snapped. Our client fell to the ground injuring his left foot.

He was taken to hospital where he was found to have fractures in his foot. These were treated conservatively in a supportive orthosis which he wore for approximately 13 months.

Irwin Mitchell brought a legal claim against the hospital which had supplied and fitted the orthosis 18 months previously. It was alleged that the hospital failed to fit out client with a brace which was of satisfactory quality.

An out of court settlement was agreed and our client received £8,000 in compensation.
