Mr McMenamin of Glasgow, is a materials tester and tests tar on the roads. He was working at the A876 when he was walking on the southbound lane and suddenly without warning he was hit from behind by a reversing Ford Transit crew bus.

Our client fell to the ground and was dragged along by the crew bus. He banged the van in an attempt to alert the driver and the bus eventually stopped with the rear offside tyre crushing Mr McMenamin.

Following the accident our client suffered pain in his right upper chest, sternum, right hip, left knee and sustained a fractured right collarbone. He attended the Accident and Emergency Department of Stirling Royal Infirmary and received a CT scan of his chest, abdomen, pelvis and cervical spine as well as an x-ray of his right shoulder. Mr McMenamin was diagnosed with a fractured right collarbone and was admitted for two nights for observation.

Mr McMenamin was referred to the fracture clinic at Stirling Royal Infirmary and a further follow up was arranged for the fracture clinic at Glasgow Royal Infirmary where he was admitted for an operation as the fracture failed to heal.

Our client continued to attend the fracture clinic and was subsequently admitted for the removal of the metalwork. Mr McMenamin also attended physiotherapy.

As a result of the accident, Mr McMenamin continues to suffer pain, discomfort and inconvenience. David Bell of Irwin Mitchell helped Mr McMenamin to secure compensation following the injuries sustained.
