Our team of litigators knows how to resolve international disputes through alternative dispute resolution, litigation, and arbitration. We act for clients operating internationally ranging from multinational conglomerates to small businesses and individuals.

We often work with clients behind the scenes to pre-empt disputes or to position clients to best advantage in case litigation becomes unavoidable.

This includes asset freezing, search and seize and disclosure orders in both the UK courts and proceedings in other jurisdictions.

International fraud and asset tracing

Fraud threatens all businesses and its impact can be particularly acute for those operating internationally.

Fraud perpetrated in one jurisdiction often involves laundering and concealment of the proceeds in other jurisdictions. Frequently this involves complex structures and may be linked with corporate insolvency.

Discovery of a fraud often results in multi-jurisdictional proceedings in which those advising require a precise understanding of how the global markets and financial systems work, of the complex (often off-shore) structures used to conceal the proceeds of fraud and an excellent knowledge of difficult legal issues, such as forum and conflicts of laws. There may also be criminal law and regulatory issues to address.

Some of our recent work bears testament to our skills and recognised expertise in this field, and includes:

  • Advising a Jordanian/Finnish joint venture company, in respect of a multimillion dollar claim arising out of the construction of a nitric acid plant in Jordan, payments due under Letters of Credit.
  • Advising on a multimillion dollar cross jurisdictional claim against a German manufacturing company under a Distributorship/Agency Agreement and Guarantee.
  • The Grupo Torras -v- Sheikh Fahad Mohammed Al Sabah and Others case, which arose out of a $450m fraud perpetrated on a subsidiary of the Kuwait Investment Office, Grupo Torras (GT). GT sought to enforce a judgment against Sheikh Fahad and the assets of trusts created by him in the Cayman Islands, the Bahamas and Jersey and brought a myriad of claims under the insolvency and bankruptcy laws of the different jurisdictions as well as other novel legal claims.
